Waiting for your work permit? Here is the real timeline for EAD approval in 2026, plus practical steps to stay productive and stress-free during the wait.

The Employment Authorization Document (EAD) is often the most eagerly awaited milestone in the marriage-based green card journey. For applicants in Indiana, understanding the real timeline and what you can do while waiting helps reduce the anxiety that comes with an uncertain wait.

In 2026, EAD processing times vary by service center but generally range from 5 to 9 months from filing. The Nebraska Service Center and the Texas Service Center are the primary locations handling marriage-based AOS cases. Premium processing is not available for I-765 applications.

Filing the I-765 concurrently with the I-485 is critical. If you wait to file the EAD application until after the I-485 is submitted, you lose the concurrent filing benefit and may face additional delays. Our Fishers office always files these forms together.

While waiting, there are several productive steps you can take. First, use this time to improve your English skills if needed — strong English will help at the green card interview. Second, organize all your immigration documents in a dedicated folder. Third, research the U.S. job market in your field so you can hit the ground running once the EAD arrives.

You cannot work legally until the EAD is in hand. Doing so violates immigration law and can jeopardize your green card application. However, you can engage in volunteer work that does not displace a paid position, and you can pursue education or training.

If your EAD is approaching expiration and your green card is still pending, you must file for renewal (Form I-765) 180 days before expiration. The auto-extension rule now provides up to 540 days of automatic extension for certain EAD categories, but planning ahead is still wise.
